Peru: Government approves regulation promoting AI use to boost economic development

The Government has approved the regulation of the law that promotes the use of artificial intelligence (AI) to foster the country's economic and social development.

This measure was made official through Supreme Decree No. 115-2025-PCM, published in the Legal Regulations bulletin of the Official Gazette El Peruano on Tuesday.

The regulation promoting the use of AI for the country's economic and social development consists of six titles, 36 articles, and six final supplementary provisions.

Likewise, it states that the implementation and sustainability of the actions set out in the regulation will be financed from the institutional budgets of the agencies involved, without requiring additional resources from the Public Treasury.

It further provides for its publication on the Peruvian Government's Single Digital Platform for Citizen Guidance and on the digital portals of the Presidency of the Council of Ministers (PCM), as well as the Ministries of Education, Production, and Justice and Human Rights.

The purpose of this regulation is to foster and encourage the development and use of AI by public entities, private sector organizations, civil society, citizenry, and academia.

Similarly, it seeks to promote the safe, responsible, and ethical use of AI-based systems, ensuring respect for human rights within the national territory as enshrined in the Constitution and in the international treaties to which Peru is a party.

It also aims to establish provisions ensuring that the development, implementation, and use of AI-based systems are carried out in a safe, ethical, sustainable, transparent, replicable, responsible, and inclusive manner.

Application

The supreme decree adds that the regulation will apply to the public administration entities set out in Article I of the Preliminary Title of the Consolidated Text of Law No. 27444, the General Administrative Procedure Law.

It also covers State-owned enterprises under the scope of the National Fund for the Financing of State Business Activity (Fonafe), as well as public companies owned by regional and local governments.

In addition, it extends to private sector organizations, civil society, citizenry, and academia that form part of the National Digital Transformation System, within the framework of the national digital transformation process, prioritizing the individual and respect for human rights.
