This measure was taken in compliance with a ruling by the
Constitutional Court (TC),
which ordered the proceedings to be returned to the intermediate stage for a new accusation review.
It should be noted that the annulment will apply to both those who requested to benefit from the effects of the Constitutional Court's ruling and those who did not.
Among those who requested to be subject to the effects of the TC ruling are the lawyers of: Jaime Yoshiyama, Ana Hertz, Efrain Goldenberg, Adriana Tarazona, Pier Paolo Figari, Luis Barboza Davila, Augusto Bedoya Camere, Vicente Silva Checa, Antonietta Gutierrez Rosati, and Mark Vito Villanela, as well as the defense attorneys of his company MVV Bienes Raices SAC and Fuerza Popular party.
Keiko Fujimori's defense —represented by lawyer Giuliana Loza— expressed partial agreement with the resolutions issued, but clarified that these do not constitute final resolutions, as they do not conclude the proceedings.
The case, which is related to alleged irregular contributions to Fujimori's electoral campaigns, must now restart from the intermediate stage (accusation review). In said phase, the court will reevaluate the evidence presented by the Public Prosecutor's Office and decide whether the case proceeds to oral trial.
It should be noted that the annulment does not imply a declaration of innocence for the accused and will apply to both those who requested to benefit from the effects of the TC ruling and those who did not.
Prosecutor's Office responds
In turn, Prosecutor Jose Domingo Perez announced that he will appeal the Judiciary's decision to annul the oral trial against Keiko Fujimori and others in the aforementioned case.
"Regarding the final resolutions, I will file the appropriate appeal and support it within the requiring timeframe," he stated.
Chlimper excluded from Cocktails case
The Judiciary also unanimously decided to annul the oral trial related to the Cocktails case with concerning the accused Jose Chlimper Ackerman, who faced charges of money laundering, false statements, and generic falsehood.
This decision means that he is completely excluded from the judicial proceedings. The case will be returned to the intermediate stage.
