Peru Gov't to file unconstitutionality action against State advertising law

Peruvian President Martin Vizcarra on Monday said his administration will file an action of unconstitutionality against the law that prohibits State-run institutions from advertising in privately-owned media.

As is known, the bill was passed at Congress' insistence last week after disapproval by the Executive Branch.

"This week, we will file an action of unconstitutionality against the law that prohibits State advertising in private media. Likewise, we will assess other measures so that the State's duty to communicate actions and services to the population is not affected. No to Gag Law," the statesman posted on Twitter.

According to the law —published today in El Peruano official gazette— public advertising will only be possible through State-run media outlets. 

However, the prohibition does not apply to cases of national emergencies, disasters, or electoral education campaigns by the electoral organizations once elections have been called.

The said law affects all public entities, including private-law ones and those subject to special regimes, as well as local and regional governments.
