The Third National Criminal Court has accepted the appeal filed by Prosecutor Jose Domingo Perez and the Anti-Money Laundering State Attorney's Office, thereby
"Grant the appeal with suspensive effect filed by the representative of the Public Ministry, against the order contained in Resolution No. 64 dated January 13, 2025," the ruling stated on Monday.
The Court also decided to elevate the case to the National Criminal Appeals Court so that it may proceed in accordance with its powers.
Following the decision of the Third National Criminal Court, the Cocktails case trial will not be annulled until the National Court of Appeals decides in second instance.
This measure was taken in compliance with a ruling by the Constitutional Court (TC), which ordered the proceedings to be returned to the intermediate stage for a new indictment review.
It should be noted that the TC's decision applied to the former presidential candidate and the defendants who had filed the request, but also to those who had not submitted it.
